CLIENT AGREEMENT

By way of providing a session deposit, you confirm that you have read and understand the terms of this agreement.

RESERVATION: A 50% deposit is required to reserve the date and time of your session. By paying this deposit, the photographer agrees to reserve the time agreed upon and will not make another arrangement for this specific time frame. For this reason, all deposits are non-refundable and shall be liquidated damages to the photographer if the date is changed, if the session becomes cancelled or if there is a breach of contract by the client.

PRICING: Services and merchandise included in the session fee are as follows:

  • 1 hour photography session (full session, extended family session) or 20 minute photography session (mini session)
  • edited digital images as per your session type

PAYMENT SCHEDULE: The aforementioned 50% non-refundable deposit is due at the time of booking. The remaining balance is payable in full at the time of your session. By way of providing a session deposit, you confirm that you have read and understand the terms of this agreement.

SHOOTING TIME: Shooting commences at the scheduled start time and ends at the scheduled end time. If the client does not arrive at the appointed time for the session, shooting will commence at the time the client arrives but will end at the originally scheduled end time.

RESPONSIBILITIES: The company is not responsible for compromised coverage due to causes beyond the control of the company including but not limited to lateness of the client, client cooperation for the photos or weather conditions/lighting conditions which may negatively impact or restrict the photo coverage.

COPYRIGHT: The photographs produced by the company are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without the company’s explicitly written permission. As the client has agreed to purchase their digital images (included in the fee), upon final payment by the client, limited copyright ownership of the resulting images will be transferred to the client. The company grants the client permission to share the images on their personal social media and with family and friends, as long as the images remain unaltered and textual credit is explicitly given to the company. The client must obtain written permission from the company prior to publishing or selling the photographs. It is understood and agreed that no images will be altered, cropped, edited or changed in any way by the client.

SOCIAL MEDIA: This clause applies to social media including, but not limited to Facebook, Instagram, and blogs. When published online, it is required that citation of the photographer be made. The client agrees that they will under no circumstances alter the photographer’s photographs that are placed in public or on the internet. The client agrees to be responsible for any family member or friend who posts photographs online and agrees that they cannot be cropped (with the exception of forced cropping on social media), altered in color, or edited in any way.

MODEL RELEASE: The client hereby assigns the company the irrevocable and unrestricted right to use and publish photographs of the client or in which the client may be included, for editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction. The client releases all claim to profits that may arise from use of images.

LIMIT OF LIABILITY: In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond the company’s control, including but not limited to camera, hard drive, or equipment malfunction, the company liability is limited to the return of all payments received for the session.

CAPTURE AND DELIVERY: The company is not liable to deliver every image taken at the session. The determination of images delivered to the client is left to the discretion of the company.

POST PRODUCTION AND EDITING: The final post production and editing styles, effects, and overall look of the images are left to the discretion of the company.

RETENTION OF DELIVERED FILES: Once the files are delivered to the client, it is the client’s sole responsibility to protect and retain their images for the future. The photographer agrees that replacement digital copies of final images may be requested up to 1 year after date received for no additional fee but retention is not guaranteed. After 1 year from received date photographer has the right to refuse to replace digital copies of images.
